Affiliate terms

1. Binding agreement

These Affiliate Program Terms (the "Affiliate Terms") are a legally binding agreement between you ("Affiliate," "you") and Astrology Geeks ("Company," "we," "us," or "our"). They govern your application to, and participation in, the Astrology Geeks affiliate program (the "Program").

By submitting an application, checking any box confirming acceptance, creating or using a referral code, or continuing to participate after we post an updated version, you agree to these Affiliate Terms, our Terms of Service, and our Privacy Policy. If you do not agree, do not apply and do not promote our services.

If these Affiliate Terms conflict with marketing copy, dashboard help text, emails, or the public affiliate landing page, these Affiliate Terms control. If they conflict with the Terms of Service on a Program-specific point (commission, attribution, payouts, clawbacks, holds, or promotion rules), these Affiliate Terms control for that point. Otherwise the Terms of Service apply.

2. Independent contractor; no agency

You participate as an independent contractor, not as our employee, partner, joint venturer, franchisee, or agent. Nothing in the Program creates an employment or fiduciary relationship. You have no authority to bind us, accept payments on our behalf, make promises we have not authorized, or represent that you speak for Astrology Geeks.

You are solely responsible for your own taxes, insurance, business licenses, tools, and expenses. You are not entitled to employee benefits, unemployment insurance, workers' compensation, or minimum wage in connection with the Program. Commissions are performance-based payments for Qualified Purchases, not wages.

3. Eligibility, application, and approval

You must be at least 18 years old (or the age of majority where you live, if higher), have legal capacity to contract, and be permitted to participate in affiliate marketing in your jurisdiction. The Program is void where prohibited.

Participation is by invitation and approval only. Submitting an application does not create any right to a code, dashboard access, or payment. We may approve, reject, delay, condition, pause, deactivate, or reopen applications and accounts at our sole discretion, with or without stating a reason, including where we believe an applicant presents legal, brand, fraud, or reputational risk.

You must provide accurate, current, and complete information, including payout details, and keep them updated. One natural person or legal entity may maintain one affiliate account unless we agree otherwise in writing. We may reclaim, refuse, or reassign vanity or referral codes that are reserved, offensive, infringing, misleading, or confusingly similar to our brand or another affiliate's code.

Approval may be withdrawn at any time. An approved account that we later deactivate or terminate is not entitled to continued promotion rights.

4. No earnings claims or guarantees

We do not guarantee approval, traffic, conversions, a 30% rate in perpetuity, any minimum income, or that any referred visit will become a Qualified Purchase. Dashboard figures, emails, and period estimates are informational tools based on our then-current records. They are not an invoice, a promise to pay, or a representation that a balance is vested or owed.

Past commission amounts, published rates, and examples are not a forecast of future results. You assume all risk that referred users do not buy, that cookies fail, that another affiliate receives last-click credit, or that we void, hold, or claw back commissions as provided here.

5. License to promote; our intellectual property

If we approve you, we grant a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use our name, referral links, and any creatives we expressly supply, solely to promote Astrology Geeks in compliance with these Affiliate Terms. We may revoke that license at any time.

We and our licensors own all rights in the Astrology Geeks name, logos, domain, site, reports, calculators, copy, and related intellectual property. You acquire no ownership. You will not register, purchase, or use domain names, social handles, app names, or paid-search terms that include or are confusingly similar to "Astrology Geeks," "AstrologyGeeks," or our other marks, except as we authorize in writing.

Referred customers are our customers. You have no right to their accounts, birth data, payment information, or relationship with us. You will not collect, scrape, or store personal data from our site or dashboard except as needed to operate your own marketing and as allowed by law.

6. Referral links and attribution

Approved affiliates may promote using a tracking parameter in the form ?ref=CODE on our URLs, or the short path /a/CODE, including any vanity code we have assigned. Attribution uses last click within a 30-day window measured from the click that set our referral cookie, as implemented in our systems.

Our servers, cookies, and payment records are the sole method for determining attribution. You acknowledge that cookies may be blocked, deleted, or fail (including because of browser settings, privacy tools, or device changes). Cookie failure, missing parameters, or a later click by another affiliate means you may receive no credit. We have no obligation to reconstruct attribution from screenshots, analytics you control, or third-party reports.

You must not alter tracking in a way that hijacks another affiliate's credit, overwrite cookies without a genuine user click, or use automatic redirects, hidden iframes, pop-unders, or similar devices to set our cookie. Any such activity is void and is cause for termination and forfeiture.

You must raise any good-faith attribution or commission dispute in writing to us within thirty (30) days after the sale date shown in your dashboard. After that period, our records are final, absent fraud on our part.

7. Qualified Purchases and commission

The standard commission rate is 30% (three thousand basis points) of the amount we actually collect from a Qualified Purchase, as recorded in our systems (typically the payment-processor amount for that charge), unless we agree a different rate with you in writing. We may round to the nearest cent.

A "Qualified Purchase" is a completed, paid purchase of eligible report credits or standalone report products that (a) is correctly attributed to your active referral code under Section 6, (b) is not a Self-Referral, (c) is not later refunded, reversed, cancelled, or made the subject of a dispute or chargeback, (d) is not fraudulent, abusive, or procured in violation of these Affiliate Terms, and (e) we have not otherwise excluded. Commission is contingent. It is not earned, vested, or payable merely because a dashboard row appears.

We may compute commission on the amount actually received from the payment processor and may exclude taxes, tips, unused credits, promotional value, adjustments, and processor fees, in our reasonable discretion and consistent with how we record the sale.

8. What is never commissionable

The following do not create commission, are excluded from payout GMV and payable period totals, and remain excluded even if shown in your dashboard for tracking:

• AstrologyGeeks Plus, other memberships, trials, and all renewals, upgrades, or related subscription charges.
• Self-Referrals: purchases where the buyer is you, your account, a payment email matching your affiliate account email, or (if we reasonably determine) a household member, employee, contractor, or instrumentality of yours, or any purchase made to generate commission rather than a genuine third-party sale.
• Refunded, cancelled, incomplete, failed, test, complimentary, or internally generated transactions.
• Purchases we reasonably determine are fraudulent, incentivized in violation of these Affiliate Terms, attributable to prohibited traffic, or associated with an inactive, paused, or terminated profile at the time of the sale.
• Amounts we never collect or later return, including partial refunds (commission is reduced or voided in proportion, as our systems record).

9. Payout calendar, method, and minimum

For tracking, sales are grouped into UTC half-month periods: calendar days 1–15 (H1) and days 16 through month-end (H2). A period's target payout date is 14 days after that period closes, rolled to the next Monday if that date falls on a Saturday or Sunday, all in UTC. We may mark a period paid on or after that date. The calendar is operational. It does not create a debt, a due date you can enforce, or a waiver of holds, clawbacks, minimums, or our right to investigate.

We generally do not release a period whose net amount is below $25.00 unless we choose to pay earlier. Amounts below the minimum may carry into a later period.

Payouts, when we issue them, are in U.S. dollars unless we state otherwise, and are sent to the PayPal, Wise, or other payout details you provide. You are responsible for the accuracy of those details and for fees, conversion, holds, or account limits imposed by your payout provider. A payment we sent to the details on file is deemed made even if you cannot access it. We have no obligation to reverse or re-issue a payment sent to an incorrect destination you supplied.

We may require tax forms or identity information (including IRS Form W-9 or W-8BEN or local equivalents) before paying, and we may withhold amounts required by law. You are solely responsible for reporting and paying taxes on commissions. We may issue tax information returns where we believe we are required to do so.

We have no obligation to pay while a payout hold is in effect, while clawback remains outstanding, while your profile is inactive, or while we are investigating a suspected breach. Marking a period paid is an administrative act. It does not waive later clawback if the underlying sale is reversed.

10. Refunds, disputes, chargebacks, and clawback

If a referred purchase is refunded, cancelled, disputed, charged back, or otherwise reversed before we mark the related period paid, the associated commission is void. It drops from that period and is not payable.

If we have already paid commission on a purchase that is later refunded, disputed (including a Stripe or card-network dispute), charged back, or that we later determine was not a Qualified Purchase, you owe us that commission as a clawback. We will apply outstanding clawback against subsequent unpaid periods, oldest first. If a later period's new commission is smaller than the outstanding clawback, the net may be zero and any remainder carries forward. A period may be closed at a net of zero.

Clawback survives deactivation and termination. If outstanding clawback is not absorbed by later commissions, you will repay the balance within thirty (30) days after our written demand. We may set off any amount you owe us (including clawback, overpayments, and losses from prohibited traffic) against any amount we might otherwise pay you. Failure to repay is a material breach.

Our determination that a sale is refunded, disputed, fraudulent, or not qualified is binding for Program purposes, based on processor notices and our records.

11. Payout holds and investigations

We may freeze payouts, without prior notice, if we reasonably suspect fraud, abuse, Self-Referrals, prohibited promotion, unusual refund or chargeback rates, identity or tax issues, a payment-processor investigation, or other activity that may harm us or our customers. During a hold, commissions may still be calculated and shown. That display is not a promise they will be paid.

Payouts remain frozen until the related processor dispute or investigation is resolved, or for 30 days from the hold date, whichever is later, unless we lift the hold earlier or keep it in place while a processor or legal matter remains open. We may extend a hold as reasonably needed to complete an investigation or await a final processor decision.

We are not liable for delayed payment, lost conversion, or cash-flow impact caused by a hold made in good faith.

12. Promotion rules, disclosures, and prohibited conduct

You must promote honestly, lawfully, and in a manner that does not mislead consumers or damage our brand. You are solely responsible for your content, channels, claims, and compliance with advertising, consumer-protection, privacy, email, and telemarketing laws in every place you promote, including the U.S. FTC Endorsement Guides, CAN-SPAM, and equivalent rules elsewhere.

You must clearly and conspicuously disclose your material connection to us (for example "#ad", "#affiliate", or equivalent language required in your market) wherever you recommend us. You must not represent our reports, calculators, horoscopes, or AI features as medical, legal, financial, psychological, or other professional advice, or as guaranteed, scientific, or infallible. Our services are for entertainment and self-reflection. Your promotion must not contradict that.

Without limitation, you will not:

• Use cookie stuffing, forced clicks, hidden frames, adware, malware, bots, or non-consensual redirects to set our referral cookie.
• Send unsolicited email, SMS, or messages; scrape or buy contact lists; or violate platform terms (including Meta, Google, TikTok, YouTube, or Apple).
• Bid on our brand name or confusingly similar keywords in paid search, or run ads that impersonate our official site, without our prior written consent.
• Register or use domains, subdomains, or handles that impersonate us or are likely to confuse users into thinking you are Astrology Geeks.
• Offer cash, credits, coupons, rebates, or other incentives for clicks or purchases unless we have approved that incentive in writing.
• Post fake reviews, testimonials, or ratings, or compensate people to review us without required disclosure.
• Target children under 18, or use our brand alongside adult, hateful, violent, illegal, or deceptive content.
• Make unauthorized discount, "official partner," employment, or earnings-guarantee claims.
• Place our links on coupon, deal, or incentive sites, or in software that injects affiliate codes, unless we approve that placement in writing.
• Appoint sub-affiliates or sell or transfer your code, except with our prior written consent.

13. Confidentiality

Dashboard data, conversion information, unpublished rates, hold or clawback details, and non-public Program mechanics are our confidential information. You will not disclose them except as required by law or as needed to obtain professional tax or legal advice under confidentiality. This obligation survives termination.

14. Changes to the Program and these Affiliate Terms

We may change commission rates, eligible products, attribution rules, payout timing, minimums, holds, prohibited-conduct rules, or Program availability at any time. We will post the updated Affiliate Terms on this page and update the version date (currently 2026-09-02). We may also notify you by email or in the dashboard.

Material changes apply to sales occurring after the updated terms are posted, except that clawback, hold, set-off, prohibited-conduct, indemnification, and limitation-of-liability provisions apply to existing accounts immediately. Your continued participation after posting constitutes acceptance. If you do not agree, you must stop promoting us and may request deactivation.

We are not obligated to grandfather a prior rate except as we have agreed in a signed writing.

15. Suspension, deactivation, and termination

You may stop participating at any time by ceasing promotion and asking us to deactivate your profile. We may suspend, deactivate, or terminate your participation immediately, with or without notice, for any reason or no reason, including suspected breach, inactivity, legal risk, or Program shutdown.

Upon termination or deactivation, your license to use our marks and links ends. You must stop representing yourself as an affiliate.

If we terminate for cause (including fraud, Self-Referrals, prohibited promotion, chargeback abuse, or material breach), all unpaid commissions are forfeited, and we may claw back amounts already paid that relate to the breach or to non-qualified sales. If we terminate or deactivate without a finding of cause, Qualified Purchases not subject to hold or clawback may be paid on a later payout date at our discretion, still subject to Sections 9 through 11.

Sections that by their nature should survive (including independent-contractor status, IP, clawback, set-off, confidentiality, indemnification, limitation of liability, and general terms) survive termination.

16. Disclaimer of warranties

THE PROGRAM, DASHBOARD, TRACKING, AND ANY MATERIALS WE PROVIDE ARE OFFERED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE TRACKING. WE DO NOT WARRANT THAT COOKIES, LINKS, OR ATTRIBUTION WILL FUNCTION ON EVERY DEVICE OR THAT DASHBOARD TOTALS ARE COMPLETE OR FREE OF DELAY.

17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASTROLOGY GEEKS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE PROGRAM OR THESE AFFILIATE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE PROGRAM OR THESE AFFILIATE TERMS WILL NOT EXCEED THE GREATER OF (A) THE NET COMMISSIONS WE ACTUALLY PAID YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). DASHBOARD ERRORS, FAILED COOKIES, AND DELAYED OR WITHHELD PAYOUTS MADE IN RELIANCE ON THESE AFFILIATE TERMS ARE SUBJECT TO THIS CAP.

Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the maximum extent permitted. These limits are a fundamental basis of the Program; we would not offer it without them.

18. Indemnification

You will indemnify, defend, and hold harmless Astrology Geeks and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your promotional content, websites, ads, or channels; (b) your breach of these Affiliate Terms or of law; (c) your infringement or misuse of intellectual property or privacy rights; (d) taxes assessed on your commissions; (e) claims by persons you referred, to the extent based on your representations; or (f) fraud, Self-Referrals, or prohibited traffic associated with your code. We may control the defense of any matter subject to indemnification; you will cooperate.

19. General

These Affiliate Terms, together with the Terms of Service and Privacy Policy, are the entire agreement on the Program and supersede prior discussions about it. We may assign them without restriction. You may not assign your account, code, or these Affiliate Terms without our prior written consent; any attempted assignment is void.

If a provision is unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the rest remain in effect. Our failure to enforce a right is not a waiver. Waivers must be in writing. There are no third-party beneficiaries except indemnified persons.

These Affiliate Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law rules, consistent with our Terms of Service. You consent to the same dispute process and forums as in those Terms, to the extent applicable.
